Task 1. Read and translate written text.
Different levels of evidence
Before the various measures of criminal proceedings - arrest, detention, involvement - can be initiated, require different levels of evidence. Legally valid are the following types of evidence:
- Suspicion: the lowest level of evidence to justify the police action. Suspicion can arise when the police have only a minor reason to believe that a crime has been committed or is being committed. It allows police to initiate an investigation.
- An educated guess: it is definite and logical conclusion emanating from the visible signs. It allows the police to detain and search a person if they have reason to believe that they are dealing with armed and dangerous people.
- Estimated occasion: the highest level of evidence exists, if there is enough credible information that a crime was committed and that the defendant committed the crime. This level is used to arrest, search and presentation of advertisements.
- The preponderance of the evidence: this means that the evidence outweighs in one direction than in another. This is sufficient for conviction in civil cases, but not enough for the prosecution of criminal cases.
It is difficult to define the difference between the different levels of evidence. Yet, different levels of proof of a good illustration of how society is trying to solve the problem of protecting the state against crime and at the same time safeguarding and protecting the freedom of the individual. The aim is to limit the unjustified and discriminatory actions of the police and at the same time ensuring compliance with the law.
