3. Military aspects of international law

During the confrontation between Indonesia and Malaysia in
1963-1966 years. 12 Malaysian Chinese, abandoned by parachute Indonesia to Malaysia, were taken captive. They were tried and found guilty of violating an internal security law of Malaysia concerning the illegal possession of weapons. They were sentenced to death.
The convicts appealed to the Federal Court of Malaysia, referring to Art. 4 of the Geneva Convention relative to the Treatment of Prisoners of War 1949
Can we consider these persons as prisoners of war, considering
that they are nationals of Malaysia?
